Mrs E.R. Cooper was appointed Special Master to
take the testimony in this case by consent of the parties on the
23d day of December AD 1898. In pursuance of this order the
Master took the testimony of the complainant G.F. Sickles
covering fifteen pages of her report. Subsequently the Com=
plainant made a motion to sell the personal property in
the hands of the Receiver in this cause An order was made
on March 1st 1899 referring the matter to the same Master
to take such testimony as was offered by the parties
The master took the testimony of the parties covering
twenty one type written pages: The master filed her
report together with with her cost bill for taking of all the
testimony by her and prayed the court to allow her costs
and order the same to be paid. This application was
upon notice to the parties. The fees were allowed but
she was directed to apportion the same in a subsequent
report to the complainant and defendants according to
the amount of testimony offered by each. She made a
report apportioning the costs in proportion to said
testimony. The Court by order dated April 3d 1899 allowed
these costs and directed their payment by the respective
parties. This order was not obeyed by the complainant
G.F. Sickles. The master then filed a petition stating
that after notice that complainant be required to pay
his proportion of the costs. Then an order was made
directing the complainant G.F. Sickles to pay the amount
of the costs taxed against him Viz: Fifty six 80/100 dollars
by the first day of May AD 1899 at 10 Oclock AM
The complainant then filed a petition for a
rehearing on the ground amongst others that the
order returned by this Court on April 3d 1899 apportioning
the costs was made without notice. The petition for
rehearing was heard on May 18 1899 all parties being
present by counsel and the petition was granted on
the ground that the complainant had no notice of
the making of the order dated April 3d 1899 fixing the
amount of costs to be paid by each party and further
