It appearing that a stenographer is
necessary to take the testimony in the above styled cause
it is hereby agreed by the counsel for the state and the
defendant that H.S. Hampton be appointed to take such
testimony Syd L. Carter

Counsel for the respective parties having agreed
upon the appointment of a stenographer in the above cause
it is ordered that H.S. Hampton be and is hereby appointed

Whereupon Robert E. Davis Esquire was duly sworn as
assistant State Attorney by the Clerk of this Court

And now this cause coming on to be
heard Syd L. Carter State Attorney prosecuting in the name
& by authority of the state of Florida and the prisoner
Walter Thomas being in open court in his proper
person as well as by his attorney J.A. Ammons Esq
And now the prisoner Walter Thomas being
brought to the bar herein under the custody of L.W. Fennell
Sheriff of Alachua County to which sheriff he is likewise
committed was demanded how he would acquit
himself of the charge as alleged in the indictment
against him, saith that he is not guilty and for good
and evil puts himself upon God and the country for
trial: Whereupon a Jury was called and there came
C.C. Townsend, S.E. Bauknight G.H. Gibbons C.C. Doke
G.R. Crump A.R. Scruggs E.M. Clark H.L. Phifer
W.R. Thomas B.T. Jordan W.W. Avera P.F. Wilson who
were duly empanelled and sworn to well and truly try
and true deliverance make between the State of Florida
and the prisoner at the bar whom you shall have in
charge according to the evidence so help you God
