of July 1899 be and the same are hereby stricken. The defendant then
moved to plead over which motion was denied to which ruling the
defendants except. It is further ordered and adjudged that a default
Judgment be and is hereby entered up against the said several
defendants, Herman Levy Principal, and J.M. Fryer and B.C. Hodges as
sureties for want of proper plea to plaintiffs declaration, and
that the plaintiff have inquisition of damages as provided by law
and the rules of practice in such cases

This cause coming on to be further heard thereupon upon
consideration hereof it is ordered, adjudged and decreed that this
cause be and the same is hereby referred to Horatio Davis Esq Special
Master in Chancery to take testimony and make a finding thereon
as provided by the statute and the rules of practice in such cases
It is further ordered that the complainant have leave to
open the depositions of Mary E. Shuford which are now on
file in this cause and that he may use the same before the
Master subject to such objections as may be made thereto
before the Master. Done and ordered at Chambers at Palatka
