                 And now this cause is continued by consent

State of Florida }
        Vs       } Assault with intent to Murder
Preston Thomas   }
                 Now this cause coming on to be heard Syd L. Carter
State Attorney prosecuting in the name and by authority of the
State of Florida and the prisoner being in open Court in his proper
person was arraigned and upon his arraignment pleaded not guilty

and H.M. Tillis & O.N. Steenberg }
                 Upon the calling of this cause for trial the
parties plaintiff and defendant by their respective attorneys
^of six good and lawful men registered voters, freeholders and not a kin to either party, selected
from the jury in attendance at said term of the court
announced ready. Whereupon a jury was called^and there came
T.E. McDonald  E.C. Crosby  J.P. Jones  W.H. Guthrie  W.A. Smith and
J.G. Sherouse who were duly empanelled and sworn to well and truly
try whether the defendants at any time within three years
before the filing of the complaint did forcibly or unlawfully enter
upon the property in the complaint mentioned and turned the plaintiff
out of the possession thereof and whether the defendants continued to
hold the possession thereof at the time of filing the complaint and to
assess such damages as may be reasonable according to the
Evidence.
      And the Jury aforesaid after hearing a part of the 
evidence the further hearing of this cause was postponed until
tomorrow morning at nine oclock
         Whereupon Court adjourned until tomorrow morning
at nine oclock.

               Friday December 15th

Court met pursuant to adjournment of yesterday
his honor W.A. Hocker presiding
   Whereupon the Grand Jury came into open Court
and made the following report to wit
