       Vs         }  Murder
G. Towney Kinnard }
                 Now this cause coming on to be heard Syd L. Carter State
Attorney prosecuting in the name and by authority of the state of Florida and the
prisoner G. Towney Kinnard being in open Court in his proper person as well
as by his attorney Evans Haile and J.S. White esquires. And now, the prisoner
being brought to the bar herein pleaded in abatement

Belford Branch       }
                Now comes the defendant by his attorney B.A. Thrasher esquire
and moves the Court to set aside the Judgment by default entered against the
defendant in the above stated cause
          And now said motion being submitted to the Court and argued by
counsel for the respective parties and the Court being advised in the premises
doth decide and order that said motion be and the same is hereby denied to
which ruling and order of the Court the defendant by his attorney then and
there excepted

                                   Motion for a New Trial
             Now came the defendants in the above stated cause and move
the Court to set aside and vacate the Verdict and judgment rendered herein
against them and to grant them a new trial
            And now said motion being submitted to the Court and argued
by counsel for the respective parties, and the Court being advised in the
premises doth decide and order that said motion be and the same is
hereby overruled. To which ruling and order of the Court the defendants by
their attorneys then and there excepted
        It is further ordered by the Court that the defendants be allowed thirty
days to prepare and settle bill of exceptions
