To Hon W.A. Hocker Judge of said County:
We counsel for the plaintiff and defendant in the above styled cause
represent to your honor that it is necessary for the interests of all
parties to this cause that the testimony to be given in the trial of this
cause be taken by a stenographer, and we agree that the same may be
taken by C.R. Layton under appointment of Court

The above coming on to be heard it is ordered that
C.R. Layton be appointed stenographer to take the testimony in the

Thereupon C.R. Layton was duly sworn as such stenographer
by the Clerk of this Court
Whereupon at the request of Syd L. Carter State Attorney
Robert E. Davis was by order of the Court was sworn as
Assistant State Attorney in the case of State of Florida Vs Sherman
Henry charged with Rape by the Clerk of this Court

And now this cause came on to be further heard
Syd L. Carter State Attorney prosecuting in the name and by authority of
the State of Florida and the prisoner Sherman Henry being in open Court
in his proper person, as well as by his attorney H.L. Montgomery and J.M. Rivers
Esquires as also the Jury who were empanelled tendered and accepted on
yesterday but not sworn to wit: J.L. Neal J.A. Manning, M.A. Densler
W.L. Hill, W.R. Stevens, J.L. Tillman, C.L. Thigpen, E.B. Lewis, E.F. Zetrouer
J.W. Keys, T.E. Brown and J.Y. Bradley who were duly sworn to well and
the prisoner at
truly try and true deliverance make between the State of Florida and ^
the bar whom you shall have in charge according to the evidence
And the Jury aforesaid after hearing a part of the evidence the further hearing of this
cause was postponed until tomorrow morning
Whereupon Court adjourned until tomorrow morning at
Nine O'clock }
