to plead, answer or demur to complaints' bill of complaint as
required by the statute and rules of practice in such cases

     vs             } Bill for Partition of Real Estate
Nicholas Bach et al }
              This cause coming on this day upon application for a decree of
partition and the appointment of commissioners to make partition herein
and it appearing to the Court that the defendants herein the said Nicholas Bach
Bertha Seiff August Brockman Earnest Brockman Karl Brockman and Edward
Weigand were duly sighted according to law to appear to this Bill on
the 6th day of November 1899 and the said defendants and each and every of
them having failed to appear or to file their plea answer or demurrer to this
bill on the 4th day of December 1899 as required by law and a decree pro
confesso having been regularly entered herein on the 4th day of December
against said defendants for want of plea, answer or demurrer, and it
further appearing to the Court from the alligations of the bill filed
herein that the complainant Warren P. Ward and the Defendant Nicholas
Bach are each the owner of and entitled to a one half interest in and
to the lands in said bill described, and it further appearing to the
Court that the alligations in said bill that the defendants Bertha
Seiff August Brockman Earnest Brockman Karl Brockmand and
Edward Wiegand and neither of them are entitled to any part or
interest in or to any of the lands herein in said bill described.
It is therefore ordered adjudged and decreed that the lands in
said bill described be partitioned and divided between and among the
parties to this suit as follows to wit: The complainant the said
Warren P. Ward shall receive one half of all lands in said
bill described, and the defendant Nicholas Bach shall receive
one half of all the lands in said bill described and the defendants
Bertha Seiff August Brockman Earnest Brockman Karl Brockman
and Edward Wiegand shall receive no part of the lands in said bill
described. And it is further ordered adjudged and decreed that
A.J. DaCosta J.J. Tinsley and J.W. Shuford who are hereby appointed 
commissioners for the purposes having been first duly sworn do proceed
to lay off and divide the real estate in the bill mentioned to wit:
Commencing at a point thirty feet south of the south West corner of
T.F. Kings lot on the East side of Prairie Street thence run South
