And now this cause came on to be heard Syd L. Carter
State Attorney prosecuting in the name and by authority of the State of Florida
and the defendants Percy Summers, Richard Lamb and Marvin Summers
being now in open court in their proper persons as well as by their attorneys
B.H. Thrasher Evans Haile and B.P. Calhoun were arraigned and upon
their arraignment each pleaded in abatement to which plea the State
Attorney demurred.
And now said demurrer to pleas in abatement being
presented to the Court and argued by Counsel for the respective
parties and the Court being advised in the premises doth decide
and order that said demurrer be and the same is hereby sustained
to which ruling and order of the Court the defendants by their
attorneys then and there excepted.
The defendants then upon arraignment each pleaded
not guilty. Thereupon counsel for the defendants moved the
Court for a continuance, and in support of said motion presented
and had filed an affidavit of the defendants. And the Court
after considering the same, granted the motion the State Attorney
not resisting
