       vs             } Bill to Foreclose a Mortgage
I.M. Putnam & Company } Decree settling the Equities Etc
        This cause coming on to be heard and the complainants
having set down the for final hearing upon the bill and answers
of the defendants and the same having been argued and submitted and
the court being advised in the premises is of opinion that the answers
of Defendants are not sufficiently full and certain to defeat the Equities
of the Bill, thereupon upon consideration hereof it is ordered
adjudged and decreed that the equities are with the complainants that
the complainants are entitled to the foreclosure of their mortgage
and that the complainants have leave to file proof of their
debt and mortgage and attorney's fees exparte for final decree
herein, in conformity to the statute and rules of practice
in such cases. Done and ordered at Chambers at Ocala Florida
on this 16th day of March AD 1900

& Percy F. Wilson & his wife Willie M. Wilson                } &C
                    The above styled cause is before me on demurrer to
the Bill of complaint and motion to dismiss the bill & dissolve the
Injunction & has been argued & submitted The Bill does not show that it
appears from the inspection of the mortgage which is assailed that
the Notary was disqualified to act in the matter = Where it does not
appear from the instrument or the record thereof that the officer was
disqualified to take the acknowledgment the record thereof is notice
to subsequent creditors & encumbrances 1 A & E Encyclopedia Law
(last Ed) p 494 & note - I think this is sound law - The 1st 3d 4th & 5th
grounds of the demurrer are sustained the 2nd ground is overruled
The Injunction is dissolved & the bill is dismissed
