This cause coming on to be further heard and it
appearing that an order was made herein on the 2nd day of March
AD 1900 overruling and denying the pleas filed by the defendant L.W.
Fennell as Sheriff of Alachua County Florida and Ex officio Administrator
of and for the estate of James B. Cullen, deceased, therein requiring
the said defendant to answer complainants bill on or before the 15th
day of March AD 1900 and said defendant having failed to answer
said bill as required by the order of the court and the complainants
solicitor moving for a decree pro confesso for failure to file
such answer, and the court being advised in the premises
thereupon, upon consideration hereof, it is ordered, adjudged
and decreed that a decree pro confesso be and the same is herein
and hereby entered up against the defendant L.W. Fennell as Sheriff
of Alachua County Florida, and ex officio administrator of and
for the estate of James B. Cullen deceased for failure to file answer
to complainants bill of complaint as required by the court, and that
complainants have leave to make proof of the allegations of their
bill exparte, and for such other and further decree herein as
may be deemed proper.
Done and ordered at Chambers at Ocala, Florida on this 23 day
of March AD 1900
