mortgagees can have no rights in equity to restrain an irreparable or
immediate trespass on the mortgaged property. And I think the bill
is bad in substance because no such injury is alleged to be threatened.
But it is certain that all persons interested in the subject matter of
litigation ought to be before the Court, and the owners of the fee
of the property described are not before the Court & the Court can
therefore render no decree on the Bill. It is therefore ordered
adjudged and decreed that the first ground of the demurrer to the
bill be and the same is hereby sustained
