and having filed affidavit in proof of Attorney's fees, and the Court
being satisfied as to the truth of the allegations contained in complainants
bill of complainant and being advised in the premises thereupon upon
consideration hereof it is ordered adjudged and decreed as
follows, to wit:
1st. That the defendant L.W. Fennell as sheriff of Alachua County Florida
and ex officio administrator of and for the estate of James B.
Cullen deceased is indebted to the complainants in the sum of
$718.17 for principal and interest due upon said Mortgage and
the taxes and insurance advanced and paid by said complainants,
together with $125 attorney's fees allowed to complainants solicitor
for the foreclosure of this mortgage together with the costs of this suit
to be taxed up by the Clerk of this Court, and that the said
defendant do pay the same within three days from date.
2nd. That upon the failure of the said defendant L.W. Fennell
as Sheriff and Ex officio administrator as aforesaid to pay
the said decree fees and costs as required by the Court then
in that case that the said mortgaged property to wit,
that certain lot, tract, piece, or parcel of land situated lying
and being in the city of Gainesville, Alachua County Florida
and particularly known an described as follows to wit: The North
half of the lot of land conveyed by E.C.F. Sanchez, Commissioner to
Sarah B. Cullen by deed dated May 6 1875 and recorded on the 14th
day of June 1875 in Deed Book "I" at page 522, of the public records
of Alachua County Florida and particularly described as follows to wit
Bounded on the East by Factory Street on the North by a street
running East and West on the West by University Street and on
the South by the South half of said block being one hundred
(100) feet North and South by two hundred (200) feet East and West
together with all and singular the tenements hereditaments and
appurtenances, to the same belonging or in anywise appertaining
be advertised and sold by J.A. Ammons Esq a Special Master in
Chancery and who is herein and hereby appointed as said Special
Master to execute this decree said sale to be duly advertised and
to be made according to law, and the said Master do pay the
proceeds arising from the sale of said property to the
complainants solicitor of record, sufficient to satisfy said
decree, and the over plus if any, as the Court may direct.
And that said Master do make proper deed of conveyance
to the purchaser of the said property and put the purchaser
in possession thereof.
3rd. That in the Event the proceeds arising from the sale of
said property shall be insufficient to pay the full amount
of said decree, then in that case that said Master report such
deficiency to the Court for such other and further order as may
be proper in the premises.
4th That after the sale of said property that said defendants
