           This cause is before me on final hearing on the
pleadings and proofs - Having given the questions involved as careful
a consideration as opportunity and time have afforded I am of
opinion that a peremtory writ of mandamus cannot be made
to apply to the exegencies of the situation as revealed by the
facts. It is therefore considered and ordered that a peremptory 
writ of mandamus be and the same is denied, to which
ruling the relator excepts -     Ocala Fla March 23rd AD 1900
This order is with out prejudice to any other appropriate
remedy in the premises
