Where as Madison S. Perry Has this day become
bound as my Security in an Appeal Bond in the case of
Gregory Yales vs John H. Lewis and wife in an appeal from
the decree of the Thomas Douglass Esq. Judge of the Circuit
Court of East Florida from the sum of Five thousand five hun-
dred dollars which said decree was entered in the office
of the Clerk of the Circuit Court for the County of Alachua
in the State aforesaid, And whereas the said John H.
Lewis is anxious to wholly indemnify and save harmless
the said Perry has agreed to execute this mortgage
Now this indenture made and entered into the 5th
day of January in the year 1850 between said John
H. Lewis of the first part, and the said M.S. Perry of the
second part witnesseth that for and in consideration
of the premises, and of the further sum of one dollar
to him the said Lewis in hand paid at and before the
sealing and delivering of these presents, he the said Lewis
hath this day bargained, sold and delivered the following
tracts or parcels of land lying in the County of Alachua
aforesiad, and in the Alachua or Arredondo Grant
known and designated as the Sections Twenty Two, Sec
Twenty Three and Sec Twenty four in Township No. Ten, Range
Twenty East containing Nineteen hundred & thirty 41/100 acres
To have and to hold the same to him, and his heirs forever
with this condition however if the said Lewis does well and truly
save Harmless the said Perry by paying and discharging the decree
or Judgement of the Appellate Court; but if the said Lewis should
not pay the same the said Perry is hereby authorized, after
giving thirty days notice to the highest bidder for cash, so
much of said land as may be sufficient to pay said,
decree and cost and all expenses and out of the pro-
ceeds to pay the same Witness my hand and seal

State and County aforesaid personally appeared John H. Lewis known to me to
be the person intended in, and who executed the within instrument, and who acknow-
ledged that he executed the same as his free act and deed In witness
whereof I have hereto set my hand & seal this 5th day of Feb AD 1851
