This Indenture made this Eight day of February  one thousand eight
hundred and fifty between Israel Foote of the City and State of New
York, of the first part, and Mary E Foote of the same place of the
second part.    Whereas in a certain cause in the Circuit Court of
the Eastern Judicial Circuit of the State of Florida in which John
H. Brush and others were complainants and Ichabod Prall and
others were defendants, a certain decretal order was made in the circuit 
court of St Johns County in Chancey, is partition dated the eleventh thirteenth 
day of November in the year one thousand eight hundred and forty
eight, by which Payne, Child and Forward were appointed commission-
-ers to sell the premises, described in the Bill of Complaint in the said
cause. And whereas the said Payne, Child and Forward subsequently
made a report to the said Court bearing date the Fifteenth day
of June in the year one thousand eight hundred and forty nine,
by which Report it appears amongst other things that the said Com-
missioners did on the Twenty first day of February one thousand eight
hundred and forty nine  expose the said premises for sale at public
auction, to the highest bidder, as directed by the said decretal order
and continued the said sale, from day to day, until the whole of said tract of
land was sold, and whereas it also appears by the said report that
the said commissioners were guided in the said sale of the said land
by the map of said grant, made by Burr, Washington and Merry late
commissioners as directed in the said decretal order, and that the copies
of the said map from which said sale was made were annexed to
the said report of the said Payne Child and Forward and were certi-
fied to and signed by them, and made a part of the said report, and
marked A & B and that the Townships, Ranges and Sections set
forth in the title of purchasers corresponds with the Townships Ranges
and Sections laid down upon said maps and that a Sale Book
marked "Sale Book;of the Arredondo Grant" and filed with the
said Report, certified by the last named commissioners, and made
a part of the said Report was kept of said sale, And whereas
it also appears by the said Report that at the said sale Section
No. 21 in Township No. 9 in Range 19 containing 639 72/100 acres
Six hundred and thirty nine acres and seventy two one hundredths
of an acre of land, of the said tract of Lands as described to be
sold as aforesaid was struck of to the said party hereto of the
first part  And whereas the said cause was brought or to be
heard upon the said Report of the Payne, Child and Forward
commissioners as aforesaid before the said court in the County of St John
