This Indenture made the fifteenth day of December one thousand
eight hundred and fifty between Eugene Van Ness and Charles W.
Brush Surviving Executors of the last will and testament of Dr.
Nehemiah Brush late of the City and State of New York deceased
of the first part and Danel Mizzell of Alachua County, State of Florida Plan
=ter of the second part, Witnesseth, that the said parties of the first part
by virtue of the power and authority to them given in and by the said
last Will and Testament, and for and in consideration of the
sum of One hundred and sixty dollars ($160) lawful money of the
United States of America to them in hand paid at and before
the ensealing and delivery of these presents by the said party of
the second part, the receipt whereof is hereby acknowledged and the
said party of the second part his heirs, executors and administrators
forever released and discharged from the same by these presents
have granted, bargained, sold, aliened, released, conveyed, and
confirmed, and by these presents to do grant, bargain, sell, alien release,
convey and confirm unto the said party of the second part his heirs
and assigns forever All that certain Section of land, situate
lying and being in the Arredondo Grant, in Alachua County State of
Florida being known and designated in a certain map of said grant
made by Messers Burr & Washington in 1846 as section Twenty
two (22) in Township Eleven (11) in Range Twenty one (21) containing
Six hundred and forty acres of land and Eighty one hundredths of
an acre of land be the same more or less said section of land
having been bid in by and struck down to the parties of the first
part for the heirs of the late Dr. Nehemiah Brush at a sale of said
land on the 21th day of February 1849, which sale was made in ac=
=cordance with an order of the Circuit Court for the County of St. Johns
Florida and by said Court confirmed at the June Term thereof
1849, as will more fully appear by reference to the papers on file on the suit of
Brush et al Vs Prall et al in the Clerk's office in the County
of Alachua in said State of Florida, where all will be
found recorded the last will and testament of the said Dr.
Nehemiah Brush deceased and the proofs thereof
Together with all and singular the edifices, buildings, rights, members
privileges, advantages, heriditaments and appurtenances to the same
belonging or in any wise appertaining: and the reversion and reversions
remainder and remainder rents issues and profits thereof And also
all the Estate right, title, interest, claim and demand whatsoever, both
in law and Equity which the said Testater had in his life time, and at
the time of his decease, and which the said parties of the first part, or
either of them have or hath, by virtue of the said last will and Testament or
otherwise of, in, and to the same and every part and parcel thereof with the appurtenances
