accorded the last will and Testament and codocil
thereto of the said Doctr N. Brush, deceased, with the
proof taken thereof
By agreement between all parties hereto this
Conveyance is executed in lieu of one executed
and delivered to the said party of the second part
by the said Dr. N. Brush during his life time for
an undivided interest of One Thousand acres of
land in the said grant, for the consideration therein
expressed of Four Thousand Dollars, Together
with all and Singular, the tenements, hereditaments,
and appurtenances to the same belonging, or in anywise
appertaining; and the reversion and reversions, remainder
and remainders, rents, issues, and profits thereof
And also all the estate right title interest, claim
and demand whatsoever, both in law and equity
which the said Testator had in his lifetime, and
at the time of his decease, and which the said
parties of the first part, as executors aforesaid have
by virtue of the said last will and Testament, or
otherwise, of, in, and to the same, and every part or
parcel thereof with the appurtenances, To have
and to hold the said premises above mentioned and
described, and hereby granted and conveyed, or intended
so to be, with the appurtenances unto the said party
of the second part, his heirs and assigns to his and
their only proper use benefit and behoof forever
And the said parties of the first part, severally
and respectively covenanting in regard to his own act
and deed, and the consequences thereof, and not in
regard to the act or deed of any other party or parties
thereof, do covenant, grant, promise, and agree in
manner aforesaid to and with the said party
of the second part his heirs and assigns, that the
said party of the second part his heirs and assigns
shall and lawfully may from time to time, and at
all times forever hereafter peaceably and quietly
have, hold, use, occupy, possess, and enjoy all and
singular the said hereditaments and premises hereby
granted and conveyed, or intended so to be, with
their and every of their appurtenances, and receive
and take the rents, issues, and profit thereof, to |
