Whereas the late Nathan Spencer deceased of Randolph
County NC died in Gainesville Florida Dec 24th 1876 & whereas the
said Nathan Spencer died leaving a will with Sarah Spencer & James
W. Spencer wife & son as executrix and executor of said will dispos-
ing of his property in Randolph County North Carolina bequeathing it
to his wife & heirs per said will certified copy of which is now on file in
the Judge of Probate Court of Alachua County Florida & whereas said N. Spen-
cer did not dispose of or mention his personal or Real property in Alachua
County Fla in said will and whereas said executors having adminis-
tered on said property in Alachua County Florida in conformity with
the laws of Florida & whereas the late Nathan Spencer having bargained to
sell certain real estate to S.F. Halliday as per written contract signed by
said N. Spencer & whereas it is provided by the statutes of Florida
for administrators duly appointed & appointed to convey Real estate in
such cases.
Now therefore be it known that this Indenture made the 12th day of
March AD one thousand eight hundred and seventy seven between
Sarah Spencer administratrix of Alachua County Fla & James W. Spencer
administrator of Randolph County North Carolina of the estate of the late
Nathan Spencer deceased parties of the first part and S.F. Halliday of
Alachua County Florida party of the second part, Witnesseth
that the said parties of the first part by virtue of the power & authority
to them given in & by the said letters of administration and for and in
consideration of three hundred and fifty dollars lawful money
of the United States to them in hand paid at & before the
sealing & delivery of these presents by the said party of the
second part the receipt whereof is hereby acknowledged and the
said party of the second part his heirs executors & administrators forever
release and discharge from the same by these presents have granted
bargained sold released aliened conveyed & confirmed & by these presents
do grant bargain sell alien release convey & confirm unto said party
of the second part his heirs & assigns forever all that certain piece or
parcel of land situate lying and being in North West quarter of Sec-
tion (4) Township ten (10) south of Range twenty (20) East in the Town of
Gainesville County of Alachua & State of Florida and which is known
and described as follows: Commencing East of Sweet Water Branch
at the North East corner of said town of Gainesville according to the
original survey of said Town & Running north thirty feet
to a stake thence east (300) three hundred Feet to a stake thence
North six hundred and forty (640) feet to a stake thence west
Four hundred and twenty (420) feet to the center of Sweet Water
Branch thence in southerly direction down the middle of said
Branch to a point directly west of said North East corner of the town of
Gainesville thence East sixty six (66) feet to said North East corner
the point of beginning containing six acres more or less together with
all and singular the Edifices buildings rights privileges hereditaments
& appurtenances to the same belonging or in any wise appertain-
ing & the reversion and reversions remainder and remainders rents
issues and profits thereof & also all the estate right title and interest
claim and demand whatever both in law and Equity which the said
