duly paid hereby agrees to sell unto the said party of the second
part one piece of land located in the Town of Gainesville, along the Sweet
Water Branch and described as follows, Beginning at the corner of Savage
Place, a stake known to be the old corner of the Town of Gainesville
thence North 30 feet to a fence, being the boundary of McCall land
Thence East 330 feet to a stake up next to a tall pine tree thence true
North 640 feet along F.C. Johnsons line Thence true West 420 feet to
the center of Sweet Water Branch Thence meandering along the
middle of said Branch south down to the line called McCall boundary
thence 66 feet East to the point of beginning comprising an area
of six acres more or less for the sum of Three hundred and fifty
dollars which the said party of the second part hereby agrees to pay
the party of the first part as follows on or before the first day of
January one thousand eight hundred and seventy seven said party
of the second part, also agrees to pay all Taxes and Assessments that shall
be taxed or assessed on said premises from the date hereof until said
sum shall be fully paid as aforesaid, and the said party of the first
part, on receiving such payment at the time and in the manner above
mentioned shall at his own proper cost and expense execute and 
deliver to the said party of the second part, or to his assigns a good
and sufficient Title in fee simple according to the piece above
described including all appurtenances on the premises belonging
thereto, It is mutually agreed between said parties that said party
of the second part shall have possession of said premises from the date

of these presents and he shall keep the same in^good condition as they are
in at the date hereof, until the said sum shall be paid as aforesaid and
in case of failure on the party of the said part of the second part to fulfill
his contract, The aforesaid amount of five dollars to be deducted
from the payment then this contract is to be void, and it is agreed
that the stipulations aforesaid are to apply to and bind the Heirs
executors administrators and assigns of the respective parties.
