if at the end of Three (3) years from the date of this instru-
ment he the Said J.T. Walls shall fail or refuse to pay up
the whole of the principal sum of money aforesaid together with
all interest thereon to accrue then he the said J.T. Walls is to
give up the possession of all of said property real and per-
sonal to the said Isaac Saunders and no longer to claim any
benefit or right under the terms of this agreement. It is further
agreed by the said J.T. Walls that he will during the harvest
time in the fall of the present year AD 1877, turn over and
deliver to I.H. Saunders Commission Merchant at Gainesville
Fla sufficient cotton of the first gatherings or pickings to pay
up the amount of this the first years interest now accruing
on said principal sum of money, which said cotton he agrees
is to be sold by said I.H. Saunders and the proceeds thereof to be
specifically applied to the payment of said annual interest by
said I.H. Saunders and which said proceeds of said cotton
he agrees is to be held and retained by said I.H. Saunders espe-
cially for the payment of said interest when it becomes due
and payable - It is hereby further expressly Stipulated and
agreed by the said J.T. Walls that in the event he shall not
be able to fulfill the terms and conditions of this agreement
upon his part agreed to be performed. And in the event he
the said J.T. Walls shall be obliged by non-performance of
his portion of the agreement hereinbefore contained to give up
the possession of said property real and personal, that then in
that event, he will not set up or claim or make any charges
for any buildings, fencing or other improvements, work or
labor that he may put up a best*** upon, in, about
or concerning any of said property real or personal
during any part of the time that he may be in pos-
session of the same, And the said J.T. Walls hereby fur-
ther stipulates and agrees that in the event he shall
become at any time unable to pay up the principal
sum of money aforesaid and annual interest thereon at the
rate aforesaid that he will turn over and deliver up
to the said Isaac Saunders all of the property hereinbefore
described both real and personal in good order and condition
as the same now stands. And the said J.T. Walls hereby fur-
ther agrees in consideration of the credit extended to him
by the said Isaac Saunders to plant out and grow and
cultivate and keep in good order One Thousand Sweet orange
trees upon the said one Hundred Acres hereinbefore described
that is excepted and reserved from the provisions of this
agreement by the said Isaac Saunders, And the said J.T. Walls
further agrees to fence and to keep fenced the said one Hundred
Acres so reserved. And further agrees to put out plant cultivate
grow and take care of said one Thousand orange trees and
to fence and keep fenced the said one Hundred Acres of land
so reserved free of any charge Whatsoever against the said
