assigns in Bankruptcy of the said Thomas E. Haile as by the said
deed or the record thereof in Liber H of record in the office of the
Clerk of the Circuit Court of said Alachua County at page 650 &c
reference being thereunto had well more fully and at large appear
and whereas the said Asahel G Darwin together with his wife
did afterwards by deed dated December 11th 1871 convey the said
lands and premises with the same exceptions and reservations unto
one Helen J Cortis as by said deed or the record thereof in said
Clerks Office in Liber H aforesaid at page 664 &c reference being
thereto had well more fully and at large appear and whereas
the said Helen J. Cortis together with her husband Thomas T.
Cortis did afterwards by deed dated May 18th 1872 convey the
said lands and premises with the same exceptions and reservations
unto John C. Smith of the first part hereto as by said deed or
the record thereof in said Clerks Office in Liber H aforesaid at
page 769 &c reference being thereunto had well more fully and
at large appear, and
Whereas the said Edward Haile did on or about
the 6th day of December 1873 by deed bearing date on that
day convey unto the said Esther Serena Haile of the second
part hereto one of said portions so excepted and reserved to wit:
the portion consisting of seventy acres of the south west part or
portion of the south west quarter of said section as by the said
deed or the record thereof in said Clerks Office in Liber I at
page 143 &c reference being thereto had well more fully and
at large appear, and
Whereas the said Edward Haile did on or
about the 6th day of December 1873, convey unto the said
Esther Serena Haile of the second part hereto (by the
name of Serena Haile) the other aforesaid portions so excepted
and reserved to wit the portion consisting of Forty acres
situate in the North west portion of the North West quarter of
said section as by the said deed or the record thereof in said
Clerks Office in Liber I at page 145 &c reference being there
to had well more fully and at large appear and
Whereas the
parties hereto are desirous of changing the location of the
premises so reserved and excepted so that the same shall adjoin
each other and shall together constitute one parcel of One
hundred and ten acres, now these presents witness that the
parties hereto have agreed and do hereby agree that the following
described premises to wit: All that certain tract of land within
said section which is bounded and described as follows to wit:
Beginning in the West boundary line of said section at a
point when the same is intersected by the middle line of the
strip of land occupied by the Florida Rail Road and running
thence Northerly along said west boundary line of said section forty
five (45) chains thence Easterly at right angles to said boundary
line thirty one (31) chains thence southerly parallel with said
boundary line twenty Six (26) chains and twenty five links (25) |
