State of Florida } Know all men by these presents that for and in
Alachua County } consideration of the sum of Five dollars to us in hand
paid at and before the ensealing and delivery of these presents the
receipt whereof we do hereby acknowledge that we Moses Endell and
Marcus Endell as partners under the firm name and style of M. Endell
and Son do hereby covenant and agree and do hereby bind ourselves
our heirs executors & administrators unto Josiah T. Walls of said
County and State that if he the said Josiah T. Walls shall well and
truly pay or cause to be paid to us the said M. Endell and Son
on or before the first day of December A.D. 1877 the sum of Twelve
hundred ($1200) dollars in good and lawful money of the United States
of America that thereupon the payment of said Twelve hundred dollars
we the said M. Endell and Son will then sell and convey unto him
the said Josiah T. Walls by good and valid title deeds all that certain
lot Block piece or parcel of land lying being and situated in the
town of Gainesville County of Alachua in the State of Florida particularly
known and described according to maps and plats of the original survey
of said Town of Gainesville as the west half of Block One (1) Range
Four (4) being in area Two hundred feet from North to South and ninety
eight and one half (98 1/2) feet from East to West together with all
and singular the tenements hereditaments appurtenances to the same
belonging or in anywise appertaining. But it is hereby expressly
understood that in the event the said Josiah T. Walls should fail
neglect or refuse to pay said Twelve hundred dollars on or before by
the 1st day of December A.D. 1877 then this agreement to sell
null and
and convey said property is to be utterlyxvoid and of no binding
validity and effects.
