and I the said M.F. Miller do hereby covenant and agree to and
with the said N.D. Phillips that I am lawfully seized in fee of
the property herein and hereby conveyed and that we have good and
lawful right to sell and convey the same; that the same is free from
all encumbrances of any kind whatsoever and that I will and my
heirs executors and administrators shall and will forever warrant
and defend the same unto him, the said N.D. Phillips and to his heirs
executors administrators and assigns against the lawful claims
and demands of any and all persons whomsoever now claiming
or hereafter to claim the same. In Witness Whereof I have hereunto

to me in hand paid by John E. Lambeth the receipt whereof I do
