George W. Sparkman to Julius A. Carlisle
"Assignment"
State of Florida } Know all men by these presents that this Assignment
Alachua County } made this the 14th day of November AD 1882 by George W.
Sparkman doing business in the Town of Gainesville Alachua County
Florida of the first part to Julius A. Carlisle of the aforesaid Town
County and State of the second part. Witnesseth That whereas the said
George W. Sparkman is indebted in considerable sums of money and
has become unable to pay & discharge the same and being desirous
of making an assignment for the benefit of his creditors - Now therefore
the party of the first part in consideration of the premises and of the
sum of one dollar to him in hand paid by the party of the second part
the receipt whereof is hereby acknowledged have granted bargained and
sold released assigned transferred and set over and by these presents
do grant bargain and sell release assign transfer and set over unto
the said party of the second part and to his heirs and assigns forever
all and singular this the two lots of lands one being situate in Ropers
Addition and the other in Mrs Jacksons Addition to the Town of
Gainesville and all the goods chattels Merchandise bills Bonds notes
Book accounts claims Evidences of indebtedness store Fixtures &
belonging to or in any way connected with the business carried on
and conducted by George W. Sparkman in and at his Store house
or place of business on North side of the Court Hous Square in the
Town of Gainesville. To have and to hold the same and every
part and parcel thereof to the said party of the second part
his heirs Executors administrators and assigns = In trust nevertheless
and to and for the following uses and purposes that is to say that the
said party of the second part shall take possession of all and singular
the lands property and effects hereby assigned and sell and dispose
of the same upon such terms as in his Judgment may appear
best and most for the interest of the parties concerned and convert
the same into money and also to collect all and singular the said
debts dues bills bonds notes accounts claims & demands or so much
thereof as may prove collectable and thereupon to execute acknowledge
and deliver
^all necessary conveyances and instruments for the purposes aforesaid and
by and with the proceeds of such sales and collections the party
of the second part shall first pay and discharge all fees expenses
costs charges and commissions of Executing and carrying into effect
this assignment and all the Taxes due or to become on the lands
aforesaid until the same shall be disposed of and by and with the
residue or net proceeds and avails of such sales and collections
