parcel of parcel of land purchased by J.H. Post
from J.M. Taylor and wife being only Fifteen (15) acres
of Land more or less   Together with all appurtenances
thereunto belonging To have and to Hold the Same
unto the said Joseph T. Smith and his heirs and as-
Signs in fee Simple absolute forever and I Andrew
T. Capen do hereby Covenant and agree to and
with said Joseph T. Smith that I am lawfully Seized
in fee of the property herein named and hereby
Conveyed and that I have good and lawful
right to sell and Convey the same that the Same
is free from all encumbrances of any Kind whatso
ever (Except two notes of ($25000)  Two hundred and
fifty Dollars Each payable to J.H. Post one due and pay-
able Oct 17th 1883 & one due and payable Oct 17th 1884
with interest at 10% the above notes the said Joseph
T. Smith agrees to pay)
And that I will and my heirs executors and ad-
ministrators Shall and will forever warrant and
defend the Same unto the said Joseph T. Smith
and to his heirs executors administrators and
assigns against the lawful Claims and demands
of any and all persons whomsoever now claiming
or hereafter to Claim the Same In witness where
of I have hereunto Set my hand and affixed
my Seal on this 16th Day of December 1882
