thence west to point of Beginning forming a
parellogram whose North line shall be equal to
the south line and the East line equal to the
west line Containing Forty (40) Acres (Being the
same Tract of land which the said Josiah T.
Walls and Ellen H. his wife by Indenture and Release
bearing date the Fifteenth day of March Anno
Domini 1878 and recorded in Deed Book K pages 51,
52 & 53 of the records of Alachua County afore
said granted and conveyed unto the said Eliz
abeth L. Nyce in fee and Isaac Saunders by
Deed Poll under his hand and seal dated the Fifteen
th day of March Anno Domini 1878 and recorded in
the aforesaid office in Deed Book K pages 53 & 54
released and relinquished unto the said Elizabeth L. Nyce
her heirs executors administrators and assigns all his
right title and interest in and to the said above descr
ibed and granted premises of and from the lien and
operation of a certain Mortgage debt second upon
a larger tract of land of which the here granted
premises were a part given and executed by the
said Josiah T. Walls to said Isaac Saunders dated
April 1, 1877 and recorded in the aforesaid office
in Deed Book J pages 393 to 398) Together with all
and singular the improvements ways streets alleys
passages waters watercourses rights liberties privileges
hereditaments and appurtenances whatsoever unto the
hereby granted premises belonging or in any wise
appertaining And the reversions and remainders rents
issues and profits thereof and all the estate right
title interest property claim and demand what
soever of her the said Elizabeth L. Nyce as well
at law as in Equity of in and to the same and
every part thereof To have and to hold the said
Tract piece or parcel of Land hereinbefore described
hereditaments and premises hereby granted or mention
ed and intended so to be with the appurtenances unto
the said Ellen H. Walls her heirs and assigns forever
And the said Elizabeth L. Nyce party of the first
part for herself her heirs executors and admin
istrators doth hereby covenant promise and agree
to and with the said Ellen H. Walls her heirs ex
ecutors and assigns that she the said Elizabeth
L. Nyce and her heirs executors and administrators
shall and will forever warrant and defend the said
