January Sixth Eighteen hundred and fifty five and
Subject to control management and sale and ap
plication of said Fund and the lands Constituting
the same by the Trustees of the Internal Improvement
Fund for the purposes of said Trust under said
Act and subject to the other provisions set forth and
refered to in the said fifth section and whereas the
said The Gainesville Ocala and Charlotte Harbor Rail
Road Company has changed its corporate name
and has adopted as its corporate name The
Florida Southern Railway Company has graded
cross-tied and Ironed and has in operation eigh
ty Miles and thirty hundredths of a mile of Rail
Road extending from Palatka in Putnam County
to Gainesville in Alachua County and from Perry
Junction now called "Gruelle" in Alachua County to
Ocala in Marion County and has applied to the
Trustees of the Internal Improvement Fund of the State
of Florida to convey to the said Company ten thous
and acres per mile for every mile of its Rail Road
so graded crosstied Ironed and now in oper
ation as aforesaid of the lands lying nearest
the line of its road its branches and extensions which
were granted to the State under said act of Cong
ress of September twenty eighth Eighteen hundred
and fifty and whereas on the petition of the said
Florida Southern Railway Company filed in the United
States Circuit Court fifth Circuit for the Northern Dis
trict of Florida in the cause then pending between Ed
ward J. Reed and Jacobus Wertheim Trustees which was
originally begun and prosecuted in the name of
Francis Vose Complainant Against the trustees
of the Internal Improvement Fund of the State of
Florida and upon showing made by the said
Trustees of the Internal Improvement Fund as to
the condition of said Fund it was ordered ad
judged and decreed in open Court on the sixth
day of January A.D. Eighteen hundred and eighty
three by the Hon Thomas Settle Judge of said
Court that the orders and decrees in the said
cause originally begun and prosecuted in the
name of Francis Vose Complainant be vacated in
So far as the same interfered with or prevented
the said trustees from conveying conveying to the
said Florida Southern Railway Company any lands
granted to said state by act of Congress of the
