assignment and by and with the residue or out of the
proceeds and avails of such sales and Collections the said James
E. Alexander shall secondly pay and discharge in full to H.F.
Dutton &Co the sum of Seven Hundred and Thirty five (735)
Dollars with the legal interest due therein. Third to pay
Fred M. Hull of Savannah Georgia the sum of Three Hundred
and Six Dollars and Ninety seven cents ($306 97/100) and Fourth
out of the residue and remainder of said net proceeds and
avails if any there shall be the said James E. Alexander
shall distribute pro rata between all the rest and
remainder of our creditors or to those holding legal claims
or demands against us. Two separate mortgage deeds having
been heretofore executed by us which are of record in the Clerks
office of the Circuit Court of Alachua County Florida in
which said Mortgages a part of the property herein conveyed and
assigned was imbraced This Deed and assignment is made
subject to the legal operation and effect of said mortgages
that is to say that so much of the property embraced in said
mortgages as Shall be legally liable for the debts secured thereby
shall be so held and applied and that the proceeds
arising from the sale of the property embraced in said
mortgages as may be legally liable for the payment of the
debts thereby secured shall be applied to the payment
of said debts and is the proceeds of said Sale be not
sufficient to discharge said debts then the creditors therein
named shall share for their remainder of their said
claims with the general creditors pro rata it being our
desire and intention by this deed and assignment that the
proceeds arising from the sale of all our property real
and personal and from the Collection of Claims due us
shall be applied to the payment of creditors as herein
before specified so far as the legal effect force and
operation of law shall permit without preference or
priority except as to the claims due H.F. Dutton &Co and
Fred M. Hull which is directed to be paid after the
payment of the expenses charges Costs &c In Witness Whereof
