This Indenture made this 30th day of October in the year of our Lord
One thousand eight hundred and twenty eight, Between Francis I Fatio of
the County of St.. Johns, of the first part and Benjamin Chaives of Leon
County both of the Territory of Florida, of the second part. Witnesseth,
That the party of the first part for and in consideration of the sum of One
thousand Dollars lawful money of the United States of America, to him in
hand paid, by the said party of the second part, the receipt whereof is hereby
acknowledged, hath granted, bargained and sold, and by these presents
doth grant bargain and sell, unto the said party of the second part and
to his heirs and assigns forever, Two thousand acres of Land being an undiv
ided part or portion of a tract of Twenty thousand acres, situated on the Big
Swamp in said Territory, and which said tract of Land, was granted to
Joseph M. Arredondo, and a Royal title made to him, by the Spanish Govern
ment, dated the 20th March 1817, which said Two thousand acres of Land
was conveyed by Deed to Francis I. Fatio, party to these presents of the first
part, bearing date, the sixteenth day of September, One thousand eight hun
dred and twenty eight, by Pedro Miranda, thro' his Attornies in fact
Charles Robiore and Waters Smith__ Together with all and singular the
hereditaments and appurtenances whatsoever to the same belonging or apper
taining, and the reversion and reversions, remainder and remainders, rents
issues and profits thereof, and also all the Estate, right title and interest, trust property
claim and demand whatsoever, both in Law and in Equity, of the said party of the
first part, in, to, or out of the said Hereditament, Lands, tenements and premises -
To have and to hold to the said party of the second part, his heirs and assigns
tot he sole and only proper use, benefit and behoof of the said party of the second
part his heirs and assigns forever, and the said party of the first part, all and
singular the above granted, Land, tenements and hereditaments, and every part and
parcel thereof, unto the said party of the second part his heirs and assigns, aga
inst him the said party of the first part his heirs and assigns, shall and will
Warrant and forever defend by these presents.-
In Witness whereof the party of the first part, hath hereunto set his hand
and seal, the day and year first above written.-
