And further that he the said Moses 
Elias Levy his heirs and assigns and all 
and every other person or person having 
or claiming any Estate, Right, title, or Interest 
in to or out of said Tracts of land and 
premises hereby intended to be granted and 
released shall and will from time to time 
after defalt shall happen to be made in pay
ment of the said sum of fifty thousand Frances 
and Interest as aforesaid contrary to the true 
intent and meaning of these presents, at the 
request cost and charges of the said Seraphina 
Chauveteau her executors administrators or 
assigns make and do and execute or cause and
procure to be made done and executed all and 
every such further and other acts deeds con
veyances and assurances in the law whatso
ever for the further and better more perfect 
and absolute granting conveying assuring and 
confirming the said Tracts parcils of land and 
premises with the appurtenances unto and to the 
use and behoof of the said Seraphina Chauveteau 
her heirs or assigns as she or they or her or 
their council in the Law shall be lawfully de
vised devised or requested.   And it is also de
clared and agreed by and between the 
said parties to these presents that until de
falt shall be made or happen to be made in 
payment of the said sum of Fifty thousand 
Frances and Interest or some part thereof 
contrary to the intent and meaning of the afore
said proviso and covenant for payment there
of it shall and may be lawful to and for the 
said Moses Elias Levy his heirs and assigns peace
ably and quietly to hold occupy possess and 
enjoy the same tracts of land and premises 
and every part and parcil thereof and to receive
