to the said Anna Ortega the damages and 
Cost aforesaid, And Whereas the said 
Marshal by virtue of the said Writs of Fieri Facias 
did on the twenty first day of January in the 
year of Our Lord one thousand eight hundred 
and twenty five levy on seize and take all 
the right and title and interest whereof the 
said Pablo F. Fontana and the said Maria 
S. Fontana were seized in a certain tract of 
land containing Three Thousand Acres situate 
in this district on a creek called Wachasasa 
and being about ten leagues south west from 
Alachua, And Whereas the said the said 
Waters Smith as Marshall as aforesaid did 
by virtue of the said Writs of Fieri Facias - 
and pursuant to the Statute in such case 
made and provided having been appresed 
according to law did duly advertise the 
premises herein before mentioned and described 
for sale on Tuesday the fifth day of July 
AD 1825 and on that day did offer the said 
premises for sale and no person bidding the 
amount of two thirds the appraised value 
and the Plaintiff in execution not offering to 
take the said land Land, at two thirds the 
appraisement the said Marshal did in 
pursuance of the Statute in such case made 
and provided, Again advertise the said 
land for sale on the sixth day of September 
one thousand eight hundred and twenty five 
and on that day did offer the said land 
for sale at public auction and no person 
bidding, the lands were not sold.  And 
Whereas by virtue of a Writ of Vendi
tioni Exponas issued out of the Superior 
Court for east Florida dated the first 
day of July in the year of Our Lord one 
thousand eight hundred and twenty six
