This Indenture made this eleventh day of 
December in the year of Our Lord one thou
sand eight hundred and twenty eight, Between 
James F. Symington of the City of Baltimore in 
Baltimore County, and State of Marylan of the 
first part, and Waters Smith of St. Augustine 
in the Teritory of Florida of the second part - 
Witnesseth that the said James F. Symington 
for and in consideration of the sum of one hun
dred and fifty dollars lawful money of the 
United States of America to him well and tru
ly paid by the said Waters at or before the sea
ling of these present the receipt whereof is hereby 
acknowledged, hath granted, bargained sold aliened 
enfeoffed, conveyed and confirmed and by these 
presents doth grant bargain sell alien enfeoff 
convey and confirm unto the said Walter Smith 
his heirs and assigns one undivided third part 
of al the estate right title interest property 
claim and demand whatsoever both in law 
and in equity of him the said James F. 
Symington in to of and out of a certain tract 
of land, situate in East Florida aforesaid 
and on a creek called Tackasasa and being 
about ten leagues south west from Alachua 
containing three thousand acres more or less, it 
being the same tract of land which was conveyed 
to the said James F. Symington by the said Wal
ter Smith as United States Marshall for the 
District of east Florida aforesaid by an 
Indenture or Deed bearing date the fifth 
day of September in the year of Our Lord 
one thousand eight hundred and twenty 
six and recorded in the Office or among the 
of the Registry of Deeds of land in Alach
ua County, in the Teritory of Florida in 
Book A page 16.           To have and
