This Indenture made the twenty seventh day of May in the year of Our
Lord, One thousand Eight hundred and twenty three, Between Nathaniel
Wells of the City and State of New York Merchant of the first part and Burr
H. Betts of the Town and County of Fairfield and State of Connecticut of the
second part, Witnesseth, that the said party of the first part for and
in consideration of the sum of five hundred Dollars lawful money
of the United States of America to him in hand paid at or before the
ensealing and delivery of these presents, by the said party of the second part
the receipt whereof is hereby acknowledged, and the said party of the decond
first part, therewith fully satisfied, contented and paid, hath granted, bargained
sold, aliened, remited, released, enfeoffed, conveyed and confirmed and by
these presents, doth grant, bargain, sell, alien, remite, release, enfeoff, con
vey and confirm unto the said party of the second part, and to his heirs
and assigns forever, Five hundred acres of land, being an undivided
part of thirty thousand, is an undivided part of a certain Great Tract
of Land, containing two hundred and eighty nine thousand six hundred
and forty five acres and five sevenths of an acre or thereabouts being
Situate, lying and being in the Alachua Teritory in East Florida west of
St. Augustine, as by reference to the grant made to don Fernando De La
Maza Arredondo and son of the said tract by the Spanish Government
which grant is dated at Havanna on or about the twenty second day of
December in the year of Our Lord One thousand eight hundred & seventeen
Will more fully appear, the said grant of two hundred & eighty nine
thousand and six hundred and forty five acres and five seventh of an acre
is to be divided into twelve equal parts, and these parts are to be balloted
for bay the parties interested in the Division to be made, which said thirty
thousand acres of Land out of which the said five hundred acres of Land
is to be taken, or of which it is an undivided part, was heretofore conveyed by
the said Don Fernando De la Mara Arredondo and son by Burr H. Betts their
Attorney to the said Nathaniel Wells, by virtue of a power of Attorney, bearing date
the sixth day of June, in the year of Our Lord One thousand eight hundred and
twenty one, and recorded in the Office of Register in and for the City & County
of New York in Lib 1 of powers of Attorney, and page two page two hundred &
twenty nine the thirteenth day of June 1821 or by reference to the said power
of Attorney, or to the registry thereof, will more fully appear, Together with
all and singular the tenements, hereditaments, rights, members, privileges
and appurtenances thereunto belonging or in any wise appertaining and reversion
and reversions, remainder and remainders, rents, issues, and profits thereof and also |
