County, December 18, 1911, at page 230 of Deed Book 83, and
said Frances being in possession thereof, but having executed
to the first party a mortgage for $ 500.00 thereon, which mort-
gage has not been foreclosed by the first party.
And the first party desiring to give possession thereof to
the second party; and the second party not desiring to with-
hold payment of said notes given to first party, other
than sufficient to indemnify himself in the matter of
securing title and possession of said lands,
The parties therefore do hereby mutually agree:
That the first party will assign to the second party said
notes and mortgage of said J.C. Frances; and the second party
may at once foreclose the same in his own name, and bid
said lands in at foreclosure sale, in the event not redeemed,
and shall then, in such event, pay to the first party the
said notes from second party to first party less one half
the actual expense and cost of such foreclosure. But, in
the event said J.C. Frances shall redeem said lands from
his said mortgage to said first party by paying the amount
thereof, or any decree on such foreclosure suit to the second
party, the second party, in that event, it is agreed between
the parties hereto, shall pay the same over to the first
party less the cash payment made by the second party
to first party on said land, and less the actual expense
and cost paid out by the second party in such foreclosure
suit; and the first party shall surrender to the second
party the notes given by second party to first party
as aforesaid.
In Witness Whereof, the parties have hereunto set their
hands and affixed their seals, in duplicate, one copy for
each party, this 21st day of February 1912.
