containing in all 4.68 acres together with all and
singular, the tenements, hereditaments, and appur-
tenances thereunto belonging or in anywise apper-
taining, and the reversions, remainder and remain-
ders, rents, issues and profits thereof and also
all the estate, right, title, interest, dower and right
of dower, property, possession, claim and demand
whatsoever of the said party of the first part,
both in law and in equity, of, in and to the
above granted premises, with the hereditaments and
appurtenances. To have and to hold the above grant-
ed premises, with the appurtenances and every
part thereof, unto the said party of the second
part, and its successors and assigns, to its own
proper use and behoof forever for the use and purpose
of the party of the second part for the track and
roadway for said Railroad, and the proper appen-
dages to such track and roadway, and for the
building thereon of depots, warehouses and other struct-
ures required for the proper transaction of the bus-
iness of said Railroad Company. Provided always,
and these presents are upon the express condition,
that the said party of the second part shall con-
struct its railway and put it in operation.
