persons and assigns, to its own proper use and
behalf forever for the use and purpose of the party
of the second part for the Track and roadway for
said Railroad, and the proper appendages to such
track and roadway, and for the building thereon
of depots, warehouses and other structures required
for the proper transaction of the business of said
Railroad company. Provided always, and these
presents are whom the express condition, that the
said party of the second part shall construct its
railway and put it in operation.

M.C. Fleming his wife personally known to me
to be the individuals described in and who executed 
the foregoing instrument, this day personally
appeared before me and acknowledged before me
that they executed said instrument for the pur-
poses therein mentioned, and I further certify
that the said M.C. Fleming personally known
to me to be the wife of said Jno T. Fleming named
in said instrument, and the one of the granted
therein, did this day personally appear before me
and on a private and separate examination this

apart from her said husband, did acknowledge
that she made herself a party to and executed
said instrument for the purpose of relinquishing,
releasing, alienating, and conveying all her right
