appurtenances thereunto belonging or in any-
wise appertaining, and the reversions, remainder
and remainders, unto, issued and profits there-
of and also all the estate, right, titles, interest,
dower and right of dower, property, possession,
claim and demand whatsoever of the said party
of the first part, both in law and in equity, of,
in and to the above granted premises, with the 
hereditaments and appurtenances. To have and
to hold the above granted premises, with the ap-
purtenances and every part thereof, unto the said
party of the second part, and its successors
and assigns, to its own proper use and behalf
forever for the use and purpose of the party of
the second part for the track and roadway for
said Railroad, and the proper appendages to
such track and roadway, and for the build-
ing thereon of depots, warehouses and other struct-
ures required for the proper transaction of the
business of said Railroad company. Provided
always, and these presents are whom the
express condition, that the said party of
the second part shall construct its railway
and put it in operation.
