The purchase price of said property to be the sum of thirty
six hundred dollars, due and payable as follows:
Fifty Dollars cash, the receipt of which in hand paid to the
first parties by the said second party at and before the ensealing
and delivery of these presents is hereby acknowledged; and the sum
of ($1050.00) One Thousand Fifty Dollars payable on or before the
expiration of the said period of three months from date hereof, or
on acceptance of the titles and deeds of the said first parties if
election hereunder be made as above provided by the said second
party within the said time; and the balance of twenty five hun-
dred dollars by assuming a certain Mortgage up to that amount
dated the 21st day of May, 1908, from the said first parties to
G.K. Broome, recorded at page 69 of Mortgage Book 37, of the
public records of Alachua County, Florida; it being understood
that the said first parties agree that the said second party,
in the event of election to pay the balance of said purchase
price shall only assume the principal sum of $ 2500 of said
Mortgage, with interest thereon from the date of the expiration of
the said three months period for which this option is given,
and will save second party harmless from any interest thereon
prior and up to said date.
It is understood that the said second party shall furnish
the abstract of title which may be required to examine into
the said title of the first parties to the said land, without any
expense to the first parties; and it is understood and agreed
that if the said second part, his heirs or assigns under
the privileges hereby granted, elects to buy the said lands
and pays the balance of the said purchase money as above
provided; the first parties will, upon said performance hereof
by second party, convey the said premises by good and
sufficient deed or deed, with full covenants of warranty,
free from all incumbrances and defects whatsoever, except
as aforesaid the said Mortgage to G.K. Broome, to be assumed
by the said second party as a party of the said purchase
price as above set forth; and in the event of the said second
party finding any other defects or flaws in the said title,
the said second party, at his option, may perfect the same,
and deduct the costs thereof from the said purchase price
or instalment thereof above mentioned.
It is further understood, however, that this option is given
on the distinct understanding that should the second party
