whereof it does hereby acknowledge, has granted,
bargained, sold and conveyed, and by these pre
sents does bargain, grant, sell and convey un
to him, the said M.S. Cheves all that certain lot,
piece, tract or parcel of land situated, lying and
being in the County of Alachua, State of Florida,
particularly described on the Plat of Evergreen
Cemetary as recorded among the Public Records of
Alachua County, Florida, as follows, to wit: "The
South Half (S1/2) of Block No. 2, Section Four (4)."
To Have And To Hold the same unto him the said
M.S. Cheves, and to his heirs, executors, administra
tors and assigns forever, as a place of permanent
interment for white persons, under the Rules and
Regulations of this Association, not to exceed one
interment in each lot. Provided However, and
these Presents are upon this express condition,
that no transfer of the above granted premises
can be made without the consent of this Asso-
ciation in writing. And it, the said Evergreen
Cemetary Association, a Corporation, does hereby
covenant and agree to and with the said M.S. Cheves
that it is lawfully seized in fee of the property
herein and hereby conveyed, and that it has good
and lawful right to sell and convey the same;
that the same is free from all incumbrances of any
kind whatsoever, and that it will, and its suc-
cessors and assigns shall and will forever war
rant and defend the same unto him, the said M.
S. Cheves and to his heirs, executors, administrators
and assigns against the lawful claims and dema
nds of any and all persons whomsoever, now
claiming, or hereafter to claim the same.
In Witness Whereof, it has hereunto set it's
hand and affixed the Corporate Seal by Irene
J. Mc Creary, its President on the 11th day of
December, A.D. 1915.
