   Friday May 6th  1853
as is required by Law.

State of Florida   }  Solicitor
       vs          } Assault with intent to kill
Charles C. Stewart }  Peden, Call, Scott
               On this day came as well the Solicitor of the State of
Florida John P. Sanderson Esqr who prosecutes the pleas of the State in this
behalf as the said Defendant by his Attorneys, J.A. Peden, G.W. Call
and J.A. Scott Esquires, and the said defendant moves the Court to
quash this Indictment, for certain reasons by him set forth, which mo-
tion was overruled by the Court, and thereupon the said Defendant
moved the Court for a postponement of the trial of this cause and
for a continuance, which motion was also overruled and the Defendant
plead not guilty, and thereupon it was agreed between the Solicitor in the
part of the State and the Defendant by his Counsel, that the same
verdict which should be rendered in the case of the State of Florida vs
Jerome N. Jones should be entered up for or against this Defendant
and the Jury coming in in said case returned a verdict of guilty of an
assault with intent to kill, and assessed a fine of one hundred dollars
and thereupon in pursuance of said agreement the same verdict is
entered in this case. And thereupon the said Defendant moved in
arrest of Judgment for certain reasons in his said motion set forth
which motion being overruled by the Court, the said Defendant
prepared and entered his bill of exceptions, and prayed that the same
might be signed and sealed as part of the record in this cause
which was done accordingly. And thereupon it was ordered by the Court
that the said defendant do stand committed until the fine and costs
of this prosecution be paid or the bond and security be given as is
required by Law

John T. Prevatt   }
                     upon motion of defendants counsel, upon
sufficient affidavit filed, this case is ordered to be continued
until next Term of this, the defendant to enter into recognizance for
his appearance at next Term.
