vs } Conviction of Manslaughter
James H. Stephens }
Prisoner was led to the Bar of the Court
by the Sheriff and being asked what he had to Say why
Sentence Should not be pronounced against him upon the
verdict of the Jury rendered upon the trial of this case
and answering that he had not The Court Sentenced
the Said James H. Stephens to be imprisoned for the term of
Six month commencing on the third day of May Inst
and also to pay to the State of Florida the fine of Five
Hundred Dollars and that he also pay the Costs of this
prosecution and that he Stand further committed
untill the Said fine and costs be paid, And it appearing
to the Satisfaction of the Court that the Jail in and for
the County of Alachua is insecure it is ordered that the
Sheriff of Alachua County do take the Said James H. Stephens
to the County of Duval and Deliver him Into the Custody
of the Jailor of the Said County of Duval

On this day came as well the Solicitor of the
State of Florida John P. Sanderson Esqr. who prosecutes the
pleas of the State in this behalf and the defendants Counsel
moved the Court to Quash the Indictment upon the Plea of
abatement filed which motion was overruled by the Court

On this day came as well the Solicitor of
the State of Florida Jno. P. Sanderson Esqr, who prosecutes the
pleas of the State in this behalf and the defendant in person
and his Counsel Messrs McIntosh, Mitchell & Wheaton and the
Said defendant pleaded not guilty thereupon came a
Jury to wit: James M. Sparkman, Wm Colson, Joseph Thomas
Wayne Tullis, Wm J. Turner, Jno B. Standley, Israel Sherouse
C. Johns, Jonas Driggers J.G. Brooker John Odom & Jno. Celon
