Reding Polk and John H. May and S.F. Halliday were excused from Serving
on the Jury
The following Jurors were absent to wit; B.T. Stokes, Soloman
Warren, L.B. Osteen, Thadius Warren, Henry Snowden, Thomas
Colden, Lewis Blackshear, Thos W. Smith, Joshua Hawkins, David
Gillett, Saml R. Piles, N.D. Hogan

Upon the calling of this case in its order on the docket
it appearing to the Court that no plea had been filed to the
declaration in the Case, upon motion of plaintiffs counsel
it is ordered that the plaintiffs do take a Judgment by default
and that the Clerk assess the damages, Whereupon the Clerk
assessed the damages a two hundred and fifty two 66/100 dollars,
Therefore it is considered and adjudged by the Court that the plaintiffs
do have and recover of and from the Said Defendants the Sum of
two hundred and fifty two 61/100 dollars, and their costs for their
damages on account of the nonperformance of the promises and
assumptions in plaintiffs declaration mentioned together with the
further sum of five -- dollars and ninety cents for and about
their suit in this behalf expended, and the Defendants in mercy &c
