Upon the calling of this case in its order on the Docket
It appearing to the Court that no plea had been filed to the declaration
in the case, upon motion of plaintiffs council, it is ordered that
the plaintiff do take a judgment by default, and that the Clerk assess the
damages, Whereupon the Clerk assess the damages at one Hundred
and eight 75/100 dollars, Therefore it is ordered and adjudged by the Court
that the plaintiff do have and recover of and from the said Defendant
the Sum of one hundred and eight 75/100 dollars, and his costs for
his damages on account of the nonperformance of the premises and assump
=tions in plaintiffs declaration mentioned, together with the further
Sum of dollars cents in and about his suit in
this behalf expended, and the Defendant in mercy &c
