and the charge of the Court, retired out of Court to consider
of their verdict, and thereupon and upon the same day, the
Said jury returned into Court and rendered the following
verdict, we the Jury find the Defendant not guilty
Whereupon the said defendant was ordered to be discharged

Levi Johns      }   McIntosh
             On this day came as well the Solicitor
of the State of Florida James M. Baker Esqr who
prosecutes the pleas of the State in this behalf, and the
Defendant in person, and his Counsel McQueen McIntosh
Esqr and the said Defendant pleads not guilty,
thereupon came a Jury to wit, 1 Robt Campbell,
2 Thos Chesser, 3 D.C. Hart, 4 J.B. Hunter, 5 G.U. Ellis,
6 W.H.G. Sanders, 7 N.A. Strobhar, 8 J. Lancaster,
9 Jonas Driggers, 10 S. Whitehead 11 E. Barrow 12 A. Dell
who were duly elected tried and sworn a true verdict to
render V.R. Prevatt David Benton and      Benton
were examined in behalf of the State and the said Jury
having heard the evidence, and the Arguments of the Counsels
and the Charge of the Court, retired out of Court to consider
of their verdict, and hereupon and upon the same day the
Said Jury returned into Court and rendered the following
verdict We the Jury find the Defendant not Guilty, Whereupon
the said prisoner was ordered to be discharged

                     Motion to Quash Indictment overruled
Now on this day comes the said prisoner by McQueen McIntosh his Attorney
and moves the Court to quash the indictment after hearing counsel and considering
the same it is ordered that said motion be denied.

S.G. Kennard         }  On this day came the Solicitor of the
State of Florida James M. Baker Esqr who prosecutes the pleas
of the State in this behalf, and the Defendant in person
and his Counsel McQueen McIntosh Esqr and the Defendant
pleads not guilty, thereupon came a Jury to wit
