                       } Now on this day comes the said defendant
and files his affidavit denying the allegations in Plaintiffs Affidavit
for Attachment, and moves to dissolve the said attachment, and
demands a jury, whereupon came, Samuel W. Burnett, Sweepson
Whitehead, Charles C. Stewart, T.J. Prevatt, Joseph Ferguson, Albert Roberts, R.A.
Ferguson, Joseph Lancaster, Henry Sweeney, H.D. Colson, Caleb Higginbotham, E. Dupree Jurors
tried elected and sworn, -- and after hearing the evidence, argument
of counsel, and having retired to consider the same returned into
Court, and rendered the following verdict; to wit, We the jurors
on our oaths do say, that the allegations in Plaintiffs affidavit
are true. - It is therefore ordered that said motion to dissolve
be overruled, and that the said defendant do pay all costs of
said motion.

     In this cause the said garnishees being Solemnly called
three times and not answering, and no answer having been filed
by said garnishees, this cause was discontinued by plaintiffs Attorney

                       This cause being called in its order on the
Docket and it appearing to the Court that the said Defendant
had been duly Summoned to appear and answer the plaintiffs decla=
=ration in the said cause, and the said Defendant failing to make
his appearance, on motion of the plaintiffs counsel it is ordered
by the court that the plaintiff do take his Judgment by default,
and that the Clerk assess the damages, whereupon the Clerk ass-
=essed the Damages at one hundred and thirty one dollars and
ninety three cents whereupon it ordered by the Court, that the
said Defendant plaintiff do have, and recover of and from
the said Defendant the said Sum of one hundred and thirty one dollars
and ninety three cents, and his costs for his Damages on account
of the nonperformance of the premises in the plaintiffs declaration
