on motion of the plaintiffs counsel, it is ordered by the court that
the plaintiff do take his Judgment by default and that the Clerk assess the
damages, whereupon the Clerk assessed the damages at one hundred and
Sixty three dollars and twenty cents, whereupon it is ordered and adjudged
by the Court that the said Plaintiff do have, and recover of and from
the said Defendant the said sum of one hundred and Sixty three
dollars and twenty cents, for his damages on account of the nonperform=
=ance of the premises in the plaintiffs declaration mentioned, and
the further sum of two dollars and 07 cents for his costs in
and about his suit in that behalf expended and the Defendant
in mercy &c

                  This cause being called in its order on the
Docket, and it appearing to the Satisfaction of the Court that
that the Defendant had been duly Summoned to appear and
answer the plaintiffs declaration in the Said cause, and the
Said Defendant failing to make his appearance, on motion
of the plaintiffs Counsel, it is ordered by the Court that
the plaintiff do take his Judgment by default, and that
the Clerk assess the damages whereupon the Clerk

assess the damages at two hundred and twenty nine dollars
twenty five cents, whereupon it is ordered and adjudged
by the Court, that the said plaintiff do have and recover
of, and from the said Defendant, the said Sum of two hundred
and twenty nine dollars and twenty five cents for his dam=
ages on account of the nonperformance of the promises
in the Declaration plaintiffs declaration mentioned, and the
further sum of four dollars and 31 cents for his costs
in and about his suit in that behalf expended and the
Defendant in mercy &c

It is ordered that all motions pleas and matters pending
in this Court, and not otherwise disposed of, to stand
continued until the next Term.

  The Court then adjourned until the Next Term in course.
