                   Upon the calling of this case in its 
order upon the Docket, it appearing to the Court, no plea 
had been filed to the declaration in this case, upon motion of 
plaintiffs Counsel it is ordered that the plaintiff do take 
a Judgment by Default and the Clerk assess the damages, 
whereupon the Clerk having assessed the damages at Sixty dollars and 
fifty Six cents, therefore it is considered and adjudged by the 
Court that the plaintiff do have, and recover of and from the 
Said Defendant the Said Sum of Sixty dollars and fifty Six 
cents for damages on account of the nonperformance of the 
premises, and the assumptions in the Said plaintiffs declaration 
mentioned, together with the further Sum of four dollars and fifteen
cents, for his costs in and about his Suit in this behalf 
expended and the Defendant in mercy &c

Ninety four dollars and Seventy eight cents, therefore it is considered 
and adjudged by the Court, that the plaintiff do have, and 
recover of and from the Said Defendant the Said Sum of 
ninety four dollars and Seventy eight cents, for his damages on 
account of the nonperformance of the premises, and assumptions 
in the Said plaintiffs declaration mentioned, together with the further 
Sum of five dollars and forty three cents for his costs in 
and about his Suit in this behalf expended, and the 
Defendant in mercy &c
