                 Upon the calling of this case in its order
upon the Docket it appearing to the Court that no plea
had been filed to the declaration in said case upon motion
of plaintiffs counsel it is ordered that the Plaintiff do
take a Judgment by Default and the Clerk assess
the Damages, whereupon the Clerk assessed the Damages
at two hundred and twenty Six dollars and eight cents, therefore
it is considered and adjudged by the Court, that the plaintiff
do have, and recover of, and from the said Defendant the
Said Sum of two hundred and twenty Six dollars and eight
cents for his Damages on account of the nonperformance
of the premises and the assumptions in the said plaintiffs
declaration mentioned together with the further Sum of
two dollars and thirty five cents for his costs in and about
his suit in this behalf expended, and the Defendant in
mercy &c

the Damages, with a Stay of Execution untill the 15th
of January next, whereupon the Clerk assessed the 
Damages at one hundred and twenty Six dollars and thirty
Six cents for his Damages on the nonperformance of the 
premises, and the assumptions in the said plaintiffs declaration 
mentioned, together with the further Sum of three dollars and 
ten cents for his costs in this and about his Suit in this behalf 
expended and the Defendant in mercy &c
