               And now on this day comes the Said plaintiff by his
attornies Smith and Bradford Esqrs and the Said Defendant though
Solemnly called comes not but makes default, and the Defendants
default in pleading having been duly entered, and the plaintiff to
Claiming to recover only on the note mentioned and set forth in his
Declaration, thereupon it ordered accordingly, and that the Clerk assess
the Damages, and the Clerk having addressed the Damages at
one hundred and twelve dollars and twelve cents, therefore it is considered
and adjudged that the plaintiff do have, and recover of, and from the
Said Defendant the Said Sum of one hundred and twelve dollars and
twelve cents for his Damages aforesaid, together with the further Sum
of two dollars and forty one cents for his costs in and about his
Suit in this behalf expended and the Defendant in mercy &c


    The Court then adjourned until 9 1/2 past tomorrow morning

                    On this day came as well the Solicitor of the State
of Florida, James M. Baker Esqr, who prosicutes the pleas of
the State in this behalf, and the Defendant in person and
his counsel G.W. Call Esqr, and the Said Defendant plead not
Guilty, thereupon came a Jury, to wit, Joseph D. Hunter,
John D.A. Weimer, Hardy Havard, James McKinney, B.R. Heinson
John Wiggins, David Benten, George M. McKinney, John H. May,
Mathew Hinson  David O. Hires, Joseph Warren, who were
elected tried and duly sworn a true verdict to render, James
Kite and William Robertson were examined as witnesses in behalf
of the State, and the Said Jury having heard the evidence and
the arguments of counsel, and the charge of the Court without
leaving their Seats, rendered the following verdict We the
Jury find the defendant not guilty,
Whereupon the said Defendant was Discharged
