the Docket, it appearing to the Court that the plea to
the Declaration in Said case has not been filed in due time

Court that the plaintiff do take his Judgment and that
a writ of inquiry do issue returnable to this Term of this
Court, and the Defendant in mercy &c

Upon the calling of this case in
its order upon the Docket it appearing to the Court
that no plea had been filed to the Declaration in
this case, on motion of plaintiffs counsel, it is
ordered that the Plaintiff do take a Judgment
against Saml W. Burnett
by Default,^and that the Clerk assess the damages,
and the Clerk having assessed the Damages at
Ninety 66/100 Dollars and Sixty Six cents therefore
it is considered and adjudged by the Court, that the
plaintiff do have and recover of and from the said
Saml W. Burnett
Dendant^the said Sum of Ninety Dollars and
Sixty Six cents for his Damages on account of the
nonperformance of the premises, and the assumptions in
the said plaintiffs Declaration mentioned, together
with the further Sum of three Dollars and
00 cents for his costs in and about his
Suit in that behalf expended, and the Defen=
